I want to start off by saying Mr.Thompson was nothing but great at responding to me and helping me get through my case. I was initially charged with 2 felonies. At the end of my case, they both got dropped and he was able to get me a better deal than I had hoped. Everything was better than I expected. I forgot to mention I live out of state so the fact that I didnt have to worry about the case thanks to Mr.Thompson was a great benefit.

I retained Attorney Theodis N. Thompson, Jr. to represent a criminal defendant in a case involving significant constitutional issues.

My concern is not that counsel failed to appear in court or failed to participate. Rather, my concern is that the record reflects unresolved constitutional questions that remained disputed throughout the proceedings.

The record reflects that a motion challenging a single-photograph identification procedure had been filed. The record further reflects the existence of a July 7, 2015 order stating that the State would not introduce the challenged out-of-court identification evidence. Yet the record later reflected uncertainty regarding whether the suppression issue had been ruled upon, whether it had been waived, and whether a hearing had ever occurred.

At trial, counsel renewed the challenge and argued that law enforcement presented only a single photograph of the accused rather than a photographic lineup. The record also reflects disputes concerning unavailable surveillance evidence and efforts to secure testimony from a co-defendant.

Years later, federal proceedings resulted in a limited remand concerning a Certificate of Appealability and the transmission of additional record materials. These developments reinforced my belief that the case contained issues that reasonable jurists could debate.

My review is based on my understanding of the court record and subsequent proceedings. Others may reach different conclusions. However, I remain concerned that significant constitutional issues reflected in the record were never fully resolved.
