Guess the bottom line here is despite that we be paid him almost $40,000. He had no clue what was happening in our case even at mediation and charged an extra $8000 to “prepare and do mediation” and still had no idea.. Now that our case has officially settled, we need to address several serious concerns about how the matter was handled. We appreciate that the case ultimately resolved, but the pattern of issues throughout the process directly impacted preparation, mediation, and the final result. Throughout the case, important details were repeatedly forgotten or had to be re-explained which ultimately led to more billing. Including things like who was part of the lawsuit, if they were licensed, who are the players were that he had talked to me about them before And actually researched their license before. During mediation, this became especially clear, including: • Not recalling that he had sent the letter instructing the contractor to leave the property when we withheld the final payment • Not remembering the motion to add the subcontractors or informing us that they were never added • Not recalling our prior $100,000 demand until the mediator mentioned it the morning of mediation, which prevented us from beginning negotiations at the full $175,000 in damages • Not knowing who would be present at mediation or that we would be negotiating solely with insurance. • Not knowing the mediation was limited only to negotiating a number, leading to hours of preparation and expenses that were unnecessary in going over tiny pricing details which were irrelevant • Not knowing the expected length and structure of the mediation Additionally, there were ongoing smaller issues that created a clear pattern of redoing work and unnecessary charges. For example, when we reminded you about the subcontractors and prior letter, your assistant had to pull those files again—time we were billed for despite having already provided the information. Questions previously answered resurfaced months later, such as whether a contractor was licensed. We were also asked multiple times to resend or restate documents that had already been submitted. We also want to clarify that our comment months ago about $100,000 “being enough” was made before we incurred ten more months of attorney fees, hired an expert witness, and discovered additional damages. As the facts changed, the strategy should have changed as well. Learning the morning of mediation that we were capped at the earlier demand significantly affected our position. With the additional $8,300 billed for mediation preparation—preparation that did not reflect critical aspects of the case—the totality of these issues is substantial. Because of the impact these oversights and omissions had on the case and the resulting financial consequences, we requested a partial refund which he declined.saying he put in the work. But based on his memory , he did not.
