When you have just been in an auto accident that was not your fault and which has caused significant physical injuries, the last thing you need and want is more stress added to your life. Instead, your biggest priority should be to focus on your health and healing. When I decided to hire the lawfirm of Joel Kofsky to represent me, I made the wrong decision which I regret. I want to say right away that I strongly do not recommend choosing them to represent you. My accident was a very clear-cut case, one that many lawyers I am sure dream about. The other driver admitted fault, I had substantial injuries, my car was totaled, I had witnesses to the accident; this is a case that SHOULD have moved along smoothly and in an extremely timely manner. This was not what happened with the Kofsky lawfirm representing me.
I did my due diligence to research lawyers and from my initial consultation with Joel, I thought I was going to be in good hands. He took my call on a Sunday while he was at home and I thought this was a good sign. Unfortunately, my experience with this lawfirm was largely defined by an extreme lack of and ineffective communication when they did return my calls. It was months until I even figured out which lawyer was assigned and I only figured out this information because I called to ask them. To be clear, during the year that followed my accident, only once did they call me first without me requesting that they call me. I called every few months to check in because every step of the way I was completely in the dark. I know that my case moved slowly, not because the process was slow, but because the lawfirm was extremely slow in its dealings with my case. To put this into perspective, at one year after my accident, the lawfirm had still failed to request a copy of the accident police report, they had not contacted any of the accident witnesses, had not retrieved loss of wages documentation, they had not given me a copy of my contract with them, and they still had not retrieved medical records from 47 of my appointments even after multiple conversations reminding them to do so.

As if all of this was not enough, right before this one year mark they asked me to do work on my case even though they were going to get paid more than enough when my case was settled. The tough position I was in, however, is that while I knew I could say no to doing work I was paying them to do, I did not trust them to do the work. I had attended over 100 appointments in a year’s time as a result of the accident. They asked me to submit to them all of the receipts, paperwork, and appt dates, info. I was paying them to gather especially since I informed them by email every time I saw a new physician. It is no surprise that I never received responses to these emails and then was asked to provide this information at other times as if I had never provided it before.

To put my case into further perspective--my now boyfriend was in an accident a year after me and he had pre-existing conditions. I had no pre-existing conditions at the time of my accident and (coincidentally) we received our settlement checks the same week. His lawyer called him at every turn and communicated very clearly; this was not the case with the Kofsky law firm and my case. Even though in my case the other insurance settled very quickly (within weeks after we said we were going to sue them) and although we immediately reached their policy limit, it took a total of four months after I agreed to accept the settlement to get the check in my hand. It took less than one month for my boyfriend to receive his settlement check after settling. Although Mr. Kofsky did grant me a fee reduction, in my opinion it was the least he could do for the awful experience. Even when I expressed concerns, things never really changed with how they handled my case and how I was treated.
