Let me explain, my wife’s immigration status is complicated. We met with three different lawyers, Paul being one of them. They all told us the same thing; we had a compelling case because I am a U.S. citizen and because we have a child with Down syndrome. BUT, if we got an unfavorable decision, then there would be no appeal, no recourse, no second chance: my wife, the mother of our intellectually disabled child, could be taken from us and deported to her home country. It is just the way the law is written, and our SAFEST strategy was to wait for immigration reform and hope for more reasonable / more humane laws regarding people with the complications my wife had concerning her status in this country. I contacted the offices of my Congressman and my Senators. And just because my current congressman might be willing to do an annual stay-of-deportation letter, does not mean that the next one will. So, we waited and waited. As our intellectually disabled son approached 18 years of age, we had a difficult decision to make because we need to petition the court for the request for Guardianship. We approached Paul and told him that we had made the decision to ask for a waiver for my wife’s situation because we needed to secure her status in the U.S. before submitting the petition for shared Guardianship of our intellectually disabled son.
