I am sharing this so others can make fully informed decisions.

My parents previously worked with Kevin Murtha to create their estate plan. We later discovered that the documents he drafted named himself as both trustee of her trust and as her power of attorney following my father’s death.
My mother currently does not need a power of attorney nor would she ever agree to allowing this.
These roles carry significant authority and, in the case of trustee, ongoing compensation. In our experience, the scope and implications of these appointments were not clearly explained or fully understood to my parents at the time the documents were executed.

After consulting new counsel, we were made aware that Florida law specifically addresses concerns related to conflicts of interest and fiduciary self-dealing (see Florida Statutes § 736.0802), as well as heightened scrutiny when attorneys benefit from documents they draft (§ 732.806).

We have currently changed any and all of my parents’ documents Mr. Kevin Murtha drafted .
It’s important every attorney makes sure when two individuals , one partner was 90 the other was 83, completely understand all documents that they sign with a total comprehension of what they are agreeing to.

I would strongly encourage anyone considering estate planning services to ask detailed questions about who is being named in fiduciary roles, how they are compensated, and to ensure full clarity before signing.
A few months after my father died my mother left a message for
Kevin Murtha and she never received a reply.

Kevin helped my elderly mom with her estate planning documents since she recently moved to the area from out of state. He was very kind and professional. I highly recommend him for any estate planning needs.

We purchased a home and hired Kevin Murtha to review and guide us on the purchasing agreement. After closing, we realized that a few conditions of the Seller were not met per the agreement and asked for Kevin's guidance and to respond to them as the advising attorney hired for this agreement. Kevin disregarded us and wouldn't even take a phone call....... Our experience with him felt unprofessional and we would not recommend his firm as a service that does not stand behind their work. You get what you pay for with a budget firm like Kevin's, save yourself the hassle and work with the more reputable firms in town.
