If you are a municipality, school district, or community group seeking independent legal counsel, pay close attention to transparency and alignment of interests.
In recent public meetings involving Valley View School District and proposed data center development, members of this firm have repeatedly spoken in favor of data centers while simultaneously acknowledging past or existing relationships with data center clients and land sellers in other municipalities. Those statements were made on the public record while advising a school district that is supposed to receive neutral, conflict-free legal guidance.
When a solicitor promotes a project while also working in the same firm that represents similar private developers elsewhere, it creates a serious appearance of conflict, even if no rule is technically broken. Public institutions deserve advisors whose loyalty is clearly and exclusively with the client they are paid to protect, not overlapping private interests.
Community members were left asking basic questions that still have not been clearly answered on the record:
Who exactly is being represented in these discussions. The public entity or private development interests.
What disclosures were made before meetings with developers.
And what conflict checks or recusals occurred, if any.
Law firms serving public bodies should operate with maximum transparency, not blurred lines between advocacy and legal advice. When the same voices defending development also have professional ties to that industry, trust erodes quickly.
If your organization values independence, disclosure, and clear separation between public duty and private business, you should ask hard questions before engaging this firm.
Legal representation should protect communities, not leave them wondering whose interests are really being served.
