Hiring Josh Fleitas at Funderburk Law was the best decision I could’ve done for my divorce case. He won my case for the best outcome for my daughter and me. I contacted this law firm after speaking with several other firms in the area. The others I spoke to either couldn’t/wouldn’t help me or wanted to charge an enormous amount of money to “try”. I had a consult with Josh Freitas and he was willing to help with my son’s issue. My son was getting ready to be paroled and in the process, we found out he had warrants out for his arrest for failure to pay fines from 2012. I was so stressed and he made me feel so at ease. Josh was able to get those warrants lifted AND get the fines reduced. I don’t live in that area so everything was done over the phone. He was very responsive, answered all my questions, and sent me all the documentation that my son needed. I am SO thankful that I found Josh and for everything he did to help my son and I. I will be forever grateful and can’t thank him enough!!

We went there to see about getting my dad's bank account released in 2021 to my mom without a will. This lawyer told us it would be over $900.00 to get less than $2000.00 out of the account. We were told to contact the probate judge because this was not right. The Probate Judge let us know this is incorrect and a only a $13.00 small estate letter was needed and this attornoy should have known that. So over $900.00 only cost $13.00. Thanks for charging us a $100.00 consult fee for nothing after telling my mom this was just pocket change and to wait 7 years if we dont want to pay the $900.00 to get the money. PLEASE CONSULT A PROBATE JUDGE BEFORE CONSULTING WITH A LAWYER!!

if I could give negative stars- I would.


I hired Eric B. Funderburk for my custody case, and it is the single worst decision I could have made for myself and my child. His failures in representation have had long-lasting consequences that I am still forced to deal with to this day.

Here are the most serious issues I experienced under his representation:
* Failure to advise: He did not properly explain the risks or consequences of relocation and custody modification, leaving me without the information I needed to make fully informed decisions.
* Failure to prepare: He went into court without fully building the factual record or presenting key evidence that was available and necessary to protect my rights.
* Failure to protect my parental rights: He did not safeguard or preserve my rights under joint legal custody, leaving openings in the order that are now being used against me.
* Failure to communicate: He repeatedly failed to respond to my concerns in a timely or meaningful way, leaving me without guidance while critical decisions were being made. I asked to have an in person conversation since all and any contact is through his assistant, penny- and i got a one hour consult with him regardinf my concerns and was charged $250 on top of the $5000 i already had paid .
* Failure to follow through: After trial, he never advised me of options for appeal, post-judgment relief, or any corrective measures when it became clear the order was not being enforced. In insisted appeal to his assistant, and with delayed action - told me appeal would be a "waste of time and money" to settle with the order given, because he knew then, he had not represented me correctly and knew appeal would not work. I was forced to find another attorney and pay $12k draining our savings and multiple loans we are still paying. Not including the $5k plus we had already paid him. I would send a concern via email and id get a statement of what's owed before i got any response to my complaints. They want money, their page falsely advertises decade plus experience, but took the sole advice and i was shamed in court for them, resulting in my daughter suffering the most from this situation.
* Failure to safeguard long-term interests: He knew I was in a high-conflict custody situation but failed to structure the case or order in a way that would prevent foreseeable issues.

I have been forced to represent myself pro se since 2023 because of how badly I was left positioned. In 2025, when preparing my answer and counterclaim, I reviewed the transcripts and finally saw in black and white the depth of his mistakes. Only then did I realize how badly I had been failed by my own attorney.

When I confronted him about these issues, his only response was that "too much time has passed" and that I should take it up with the Bar Association. No accountability, no acknowledgment, just dismissal.

The truth is this: time does not erase incompetence. Clients trust their attorney to fight for them and protect their interests. Eric B. Funderburk did not do that for me. His neglect still affects me later, alone, while still fighting for my child.

If you are considering this firm, I strongly urge you to look elsewhere. My experience shows that once you leave his office, you are on your own -- and when the damage shows itself later, you will get nothing but excuses.
